General Terms and Conditions of HiFi Studio Sulzer AG
1. Scope:
The following General Terms and Conditions (GTC) apply to the business relationships between HiFi Studio Sulzer AG (hereinafter referred to as “HiFi Sulzer”), Aemtlerstrasse 44 8003 Zurich and its customers. Any natural or legal person who maintains a business relationship with HiFi Sulzer is referred to as a customer. The customer confirms that they fully accept these General Terms and Conditions, including the terms of delivery and payment When using the HiFi Sulzer website or when ordering goods.
2. Use of our services/offers and website:
Our shop and the HiFi Sulzer website contains information about products and services from various manufacturers. We reserve the right to change prices and product range as well as changes to technical data at any time.
HiFi Sulzer makes every effort to ensure that all details and information on our website are up-to-date, correct and complete. HiFi Sulzer cannot guarantee this, either expressly or implicitly.
HiFi Sulzer cannot guarantee that the products listed are available at the time of ordering. Therefore, all information on availability and delivery times is not guaranteed and can change at any time and without notice.
3. Prices:
HiFi Sulzer prices including the statutory value added tax (VAT), any early recycling fees (VRG) and copyright fees (Swico) for electronic devices. The prices are net in Swiss francs (CHF). Repairs and used items do not include VAT.
Unless otherwise provided, any shipping costs will be charged additionally and must be paid by the customer.
We reserve the right to make technical changes, errors and misprints. In particular, HiFi Sulzer can make price changes at any time and without prior notice. The sales prices do not include any consulting and support services.
4. Conclusion of contract:
The offers in the shop and on this website represent a non-binding invitation to the customer to order products and/or services from HiFi Sulzer.
With the order in the shop or via this website, the customer makes a legally binding offer to conclude a contract, including the acceptance of these General Terms and Conditions. Orders placed are binding for the customer. Unless otherwise noted, there is no right of return or withdrawal.
The contract is concluded as soon as HiFi Sulzer confirms the order orally or in writing.
If, after conclusion of the contract, the ordered goods cannot be delivered or cannot be delivered in full, HiFi Sulzer is entitled to withdraw from the entire contract or part of it.
If the customer’s payment has already been received by HiFi Sulzer, the payment will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. If the contract is terminated, HiFi Sulzer is not obliged to make a replacement delivery.
5. Delivery:
Deliveries are made from our office in Zurich. Transport damage must be reported immediately to the post office or shipping company so that claims can be asserted.
We ship our products exclusively in Switzerland and Liechtenstein. Deliveries abroad are made by prior arrangement, the customer bears the postage costs.
6. Delivery times:
Non-compliance with the delivery deadlines by HiFi Sulzer only entitles the buyer to withdraw from the contract if the delivery has not been made after the expiry of 7 days.
EXCEPTION: In the case of special orders (delivery delays caused by the supplier (hand-made hi-fi), it is no longer possible to withdraw from the purchase contract.
Delays in delivery under no circumstances justify claims for damages.
7. Payment and retention of title:
The following payment options are available to customers in the business premises in Zurich. Cash payment, EC or Postfinance.
All other credit cards are accepted with a 3.5% surcharge.
In the case of postal delivery, payment in advance always applies.
HiFi Sulzer reserves the right to exclude customers from individual payment options without giving reasons or to insist on prepayment.
The products delivered to the customer remain the property of HiFi Sulzer until full payment has been made.
8. Goods inspection:
Complaints must be reported in writing to HiFi Studio Sulzer AG within 5 days. The date of the postmark is decisive. After this period, no more complaints will be processed. Returns are at the expense of the buyer.
9. Returns and Exchanges:
Exchange or return of goods delivered in accordance with the contract is only possible after consultation. The buyer accepts that HiFi Studio Sulzer AG will charge an administrative fee.
10. Guarantee:
HiFi Sulzer’s warranty for the products it supplies is determined in every respect by the warranty provisions of the respective manufacturer/supplier. The customer waives further warranty claims against HiFi Sulzer and the manufacturer/supplier. HiFi Sulzer’s only obligation is to assign any warranty claims it may have against the manufacturer/supplier to the customer. The customer acknowledges that, based on the applicable warranty provisions, the warranty usually extends to repair or replacement of the defective/defective products and also only applies if the products remain in Switzerland. Furthermore, the customer acknowledges that a defect only exists in any case if it is reported to HiFi Sulzer in writing or in person immediately after discovery and a relevant and contains reproducible errors. The warranty is excluded in particular for defects that are based on one of the following causes:
- inadequate maintenance
- Failure to observe the operating or installation regulations
- improper use of the products
- Use of unauthorized parts and accessories
- natural wear and tear
- Transportation, improper handling or treatment-modification or attempted repairs
- External influences (e.g. water and fall damage, force majeure (e.g. failure of the power supply, natural hazards) and other reasons for which neither HiFi Sulzer nor the manufacturer/supplier are responsible.
11. Liability:
HiFi Sulzer accepts no liability whatsoever for damage caused by improper installation or improper use.
HiFi Sulzer excludes claims for damages against HiFi Sulzer and any auxiliary persons and vicarious agents. In particular, HiFi Sulzer is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage or pure financial loss of the customer.
12. Privacy
HiFi Sulzer assures that the collection, processing and use of personal customer data will comply with the provisions based on Article 13 of the Swiss Federal Constitution and the federal data protection regulations (Data Protection Act, DSG).
The customer data generated during the sales process is only used for internal purposes at HiFi Sulzer. Personal data will be treated as strictly confidential and will not be sold or passed on to third parties. A transfer to third partner companies only takes place if it is absolutely necessary for the sale / repair process.
The customer agrees to the use of his data as described above.
13. Jurisdiction:
The place of jurisdiction for all legal relationships is the registered office of HiFi Sulzer. The court in Zurich is responsible. Swiss law applies exclusively.
HiFi Sulzer expressly reserves the right to change these General Terms and Conditions at any time and to implement them without notice.
